The short version: this website has no forms, no accounts, no analytics, no advertising and no cookies. We only learn about you if you choose to message us, and we use what you tell us only to look after you.
1. Who we are
Hemchand is a family business in Mumbai, India, dealing in diamond jewellery, art and antiques since 1905. In this policy, “we”, “us” and “our” mean Hemchand, and “you” means anyone who visits hemchand.in or contacts us through it. We decide how and why your personal data is used, which makes us the “data fiduciary” under India’s Digital Personal Data Protection Act, 2023.
2. What we receive, and when
When you simply visit
We do not collect anything ourselves. Our website host, Cloudflare, processes the technical information every website needs to deliver pages and keep them safe, such as your IP address, browser type and the pages requested. Cloudflare handles this under its own privacy policy; we do not use it to identify you.
Our fonts and images are served from our own site. The Rooh film is streamed from a content delivery network, which, like any web server, receives your IP address when the film loads.
When you message us on WhatsApp
The appointment and “ask about this piece” buttons open WhatsApp with a message ready for you to send. Nothing is sent until you press send. If you do, we receive your name and number as shown on WhatsApp and whatever you choose to share: the piece you are asking about, photographs, sizes or ideas. WhatsApp is run by Meta under its own terms and privacy policy.
When you become a client
To make, deliver and invoice a piece, we may need your name, contact details, delivery address, order and payment records, and, where Indian law requires it for higher-value purchases, identity or tax details such as your PAN.
3. How we use it
- to reply to you and arrange a private appointment or video call;
- to prepare drawings, quotations and certificates for your piece;
- to make, hallmark, certify, insure and deliver what you have ordered, and to care for it afterwards;
- to keep the business, accounting and tax records the law requires;
- to protect our clients, our business and this website from fraud or misuse.
We do not use your data for advertising, we do not build profiles, and we never sell or rent it to anyone.
4. Our basis for using it
We rely on the consent you give when you choose to contact us, and on the “legitimate uses” the Digital Personal Data Protection Act allows, such as carrying out what you have asked us to do and complying with the law. You may withdraw your consent at any time; this does not affect anything already done, or records we must keep by law.
5. Who we share it with
Only those who need it to do their part, and only what they need:
- our own craftsmen and workshop, who usually see only the design and its measurements;
- independent gemmological laboratories and BIS hallmarking centres, which receive the piece for certification;
- couriers and insurers, for safe delivery;
- banks and payment providers, and our accountants and advisers;
- government and regulatory authorities, where the law requires it.
6. Cookies
We do not set cookies and we do not use analytics or tracking tools of any kind. Your browser may keep copies of our pages and images to load them faster next time; that stays on your device.
7. How long we keep it
We keep personal data only for as long as we need it for the purpose you gave it to us, and for as long as Indian tax, accounting and other laws require us to keep business records. After that it is deleted.
8. How we protect it
We take reasonable security measures to protect your data, including limiting who in the family business can see it. This website is served only over encrypted connections and is built without databases or logins that could be attacked.
9. Your rights
Under the Digital Personal Data Protection Act, 2023 you may ask us:
- for a summary of the personal data we hold about you and how we use it;
- to correct, complete or update it;
- to erase it, where we no longer need it and the law does not require us to keep it;
- to withdraw your consent;
- to address a grievance; and
- to note someone who may exercise these rights for you in the event of your death or incapacity.
Write to Aman Hemchand, by email at hemchand9999@hotmail.com or on WhatsApp at +91 99307 27247. We will reply as soon as we can, and in any case within the time the law allows. If you are not satisfied with our answer, you may complain to the Data Protection Board of India.
10. Children
This website is not directed at children. We do not knowingly accept personal data from anyone under 18 without the consent of a parent or guardian.
11. Changes to this policy
If we change how we handle personal data, we will update this page and the date below.
12. Contact and grievances
For any question about your personal data, or to raise a grievance, please contact Aman Hemchand, by email at hemchand9999@hotmail.com or on WhatsApp at +91 99307 27247.
